1. Acceptance of Terms

By accessing or using the TeslaQuake website, dashboards, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

TeslaQuake provides a research platform exploring electromagnetic-seismic correlation, including Schumann resonance, Tesla telluric frequency, ionospheric, and geomagnetic precursor analysis. The Service publishes research observations, visualizations, and educational materials based on our patent-pending technology (USPTO 63/927,569 · 63/953,591 · 63/973,214).

3. Research Status & No Guarantees

TeslaQuake is in an active research and validation phase. All correlation observations and forward-looking statements are provisional and may be revised as additional data is collected and reviewed. We make no representations or warranties — express or implied — about the accuracy, completeness, reliability, or timeliness of any observation.

4. Acceptable Use

You agree to use the Service only for lawful purposes and not to:

• Misrepresent, fabricate, or selectively redistribute research outputs without proper attribution and context
• Use research outputs to make life-safety decisions in place of official emergency guidance
• Attempt to access, probe, or disrupt non-public portions of the Service
• Scrape, mirror, or republish substantial portions of the platform without written permission
• Use the Service in violation of any applicable law, regulation, or third-party right

5. Intellectual Property

All technology, algorithms, software, dashboards, written content, visual designs, and the TeslaQuake™ name are owned by Brian Lee Westfall and protected by U.S. and international intellectual property law, including pending patents. No license is granted by use of the Service. Press and academic citation with attribution is permitted under fair use principles.

6. Limitation of Liability

To the maximum extent permitted by law, TeslaQuake, its founders, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including loss of life, personal injury, property damage, lost profits, or data loss — arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

7. Indemnification

You agree to indemnify and hold harmless TeslaQuake and its founder from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Service or your violation of these Terms.

8. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

9. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted at this URL with an updated "Last Updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Tarrant County, Texas, and you consent to personal jurisdiction there.
